Substance Abuse and Alcohol Misuse Policy
Purpose
The New Day Company, LLC (“Company”) is committed to ensuring a safe, healthy, and productive work environment for all employees. This Substance Abuse and Alcohol Misuse Policy outlines our stance on the use of drugs and alcohol and provides guidelines for maintaining a workplace free from substance abuse.
Scope
This policy applies to all employees and contractors of The New Day Company, LLC.
Policy Statement
The Company strictly prohibits the use, possession, distribution, or sale of alcohol, illegal drugs, or controlled substances on company premises or while conducting company business.
Prohibited Conduct
- Alcohol Misuse:
- The consumption of alcohol during work hours or in company vehicles is strictly prohibited.
- Employees must not report to work under the influence of alcohol.
- Illegal Drugs and Controlled Substances:
- The use, possession, or being under the influence of illegal drugs or non-prescribed controlled substances on company property or while on duty is strictly forbidden.
- Prescription Medication:
- Employees using prescribed drugs must consult with their healthcare provider about the medication’s impact on their fitness for duty and must inform their supervisor if any job restrictions are necessary.
Testing
- The Company reserves the right to conduct pre-employment, post-accident, random, and reasonable suspicion drug and alcohol testing.
- Compliance with testing requirements is a condition of employment.
Assistance and Rehabilitation
- Employees with substance abuse problems are encouraged to seek help. The Company may assist in providing access to rehabilitation and substance abuse programs.
- Participation in such programs or seeking help voluntarily will not jeopardize employment, provided the employee complies with the Company’s policies.
Disciplinary Actions
- Violation of this policy will result in disciplinary action, up to and including immediate termination.
- Employees who refuse to submit to a required drug or alcohol test may also be subject to termination.
Compliance
- The Company is committed to complying with all applicable federal, state, and local laws related to workplace substance abuse.
- Employees are required to adhere to the requirements of the Department of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA) regarding drug and alcohol testing.
Education and Training
- The Company will provide training on the dangers of drug and alcohol use in the workplace.
- Supervisors will receive additional training to recognize signs of substance abuse and understand proper intervention techniques.
Confidentiality
- All information related to drug and alcohol testing or an employee’s participation in a rehabilitation program will be handled confidentially in accordance with applicable laws and regulations.
Policy Review and Updates
- This policy will be reviewed regularly and updated as necessary to ensure compliance with the law and best practices.
