Scope
This policy applies to all employees, contractors, and agents operating under the authority of The New Day Company, LLC.
Policy Statement

FMCSR Compliance Programs
- Driver Qualifications:
- Ensuring all drivers meet the FMCSA’s requirements for a commercial driver’s license (CDL) and are properly trained and qualified to operate commercial motor vehicles (CMVs).
- Hours of Service (HOS):
- Monitoring and enforcing compliance with HOS regulations to prevent fatigue-related incidents.
- Maintenance and Inspection:
- Regularly inspecting, maintaining, and repairing vehicles in accordance with FMCSA standards to ensure they are safe and reliable.
- Alcohol and Drug Testing:
- Conducting pre-employment, random, reasonable suspicion, post-accident, return-to-duty, and follow-up drug and alcohol testing as per FMCSA requirements.
- Accident Reporting:
- Establishing procedures for prompt and thorough reporting and investigation of all accidents involving CMVs.
- Hazardous Materials:
- Adhering to FMCSA regulations regarding the transportation of hazardous materials, including proper marking, labeling, placarding, and documentation.
- Record Keeping:
- Maintaining accurate records for driver qualifications, vehicle maintenance, HOS logs, and other documentation as required by the FMCSA.
- Training:
- Providing ongoing training to ensure that all employees are knowledgeable about FMCSR requirements and any changes to regulations.
Responsibilities
- Management is responsible for establishing and maintaining compliance procedures, providing necessary resources, and ensuring employees are trained.
- Drivers and Operators must understand and comply with FMCSRs relevant to their duties.
- Safety and Compliance Officers are responsible for the oversight of compliance programs, conducting audits, and taking corrective actions when necessary.
Compliance
- Non-compliance with FMCSRs can result in disciplinary action, up to and including termination.
- Violations can also result in fines, penalties, and reputational damage to The New Day Company, LLC.
Reporting and Monitoring
- Employees must immediately report any potential violations or concerns related to FMCSR compliance.
- Regular audits will be conducted to ensure ongoing compliance with FMCSRs.
Review and Update
- This policy will be reviewed annually or as needed to reflect changes in FMCSA regulations and industry best practices.
